Abstract
A fair trial is based on several principles, the most important of which is the right to litigation on two levels, which is considered a legal guarantee for the accused in order to consider the judgment issued against him at the level of the first degree before a higher one, and given the importance of this right in devoting the principle of a fair trial organized by the Algerian legislator At the core of the Code of Criminal Procedures according to Law 17/07 amending and supplementing the Code of Criminal Procedures.
