The Algerian experience in implementing the electronic court

Abstract

Most countries in the world, especially those with a wide Internet network on their territory,have adopted the electronic litigation mechanism as a modern means to manage and improve the justice sector by bringing justice closer to litigants in terms of time and place. Algeria is among these countries that seek to embody electronic litigation by creating legal and regulatory texts that allow the framing of electronic litigation procedures, which began to be embodied under Law No. 15-03 relating to the modernization of justice, as well as Order No.20-04 amending the Code of Criminal Procedure, which came with an amendment allowing remote trials, which was imposed by the Corona pandemic.My intervention revolves around clarifying the legal texts that the legislator has created in this field and the extent to which they organize and simplify litigation procedures, whether in the criminal, civil or even administrative field, as well as the extent to which these legal and regulatory texts respond to the requirements of the judiciary and achieve its objectives in resolving disputes brought before it by preserving the rights and freedoms of the parties from loss.
