The aspects of submission and the manifestations of abstraction between original and pure debts

Abstract

The idea of subordination and abstraction between original and pure debt is one of the most important topics that have not received sufficient research and is still specific to the issue of subordination to the rules of original debt falling on the most important direct relations in the commercial paper, and the question of abstraction of the pure obligation from any rule of the original debt has been discussed.On this basis, this study will be based on some jurisprudence, jurisprudence and legislative laws that form its main axis on two questions:First: It aims to indicate the most important aspects of subjection through which the facts can be deduced that indicate the impact and influence of primary and morphological debts, while between them and the limits of this subjection.
The other: It aims to clarify the most important aspects of abstraction through which the facts can be deduced that indicate the independence of these debts from each other.
