Between Alternative Justice and National Judiciary: A Legal Approach

Abstract
Experience has shown that the intention to completely eliminate the judge's role in arbitrationproceedings does not necessarily enhance the effectiveness of arbitration. Arbitration is not anentirely autonomous mechanism. In fact, if one party refuses to comply with the arbitrationagreement, the process itself may collapse. In such instances, turningto the judiciary becomesessential to safeguard the integrity of arbitration.
