Abstract
Since its opening to a market economy, Algeria has been striving to adopt the fundamental principles of a free economy. Enhancing the principle of free competition is considered the main means to achieve openness and invigorate the economy. Since the constitution is regarded as the highest law, it provides strong guarantees for adherence to the fundamental principles that include individual and collective rights and freedoms, as well as ensuring the legitimacy of the authorities' practices and providing legal protection in a society governed by law .
